1. Rental Estimate and Payment

Starting Arts will provide the Renter with a rental estimate before pickup or delivery of the rental items. The estimate will include the anticipated rental fees for the costumes, props, sets, and/or technical equipment requested by the Renter.

The Renter agrees to pay the amount listed in the rental estimate at the time of pickup according to the payment requirements outlined in this agreement.

The Renter also agrees to pay for any additional costumes, props, set pieces, technical equipment, or other rental items added at pickup or delivery that were not included or contemplated in the original rental estimate.

Additional items selected at the time of pickup will be added to the rental total and must be paid for according to the applicable payment terms.

Starting Arts reserves the right to adjust the final rental total to reflect additional items, services, consultation fees, damages, late fees, replacement costs, or other charges authorized under this agreement.

2. Rental Fees and Minimum Rental

Costumes

All costume rentals are subject to a minimum rental charge of $100.

A rental estimate will be provided to the Renter before pickup. The Renter agrees to pay the estimated rental amount at the time of pickup, along with the cost of any additional costumes selected that were not included in the original estimate.

The rental fee includes 30 minutes of assistance or consultation from a Starting Arts costumer. Additional consultation time will be charged at a rate of $25 per hour and added to the rental total.

Props, Sets, and Technical Equipment

A rental estimate will be provided to the Renter before pickup.

The Renter agrees that the full estimated rental amount is due at the time of pickup. Any additional props, set pieces, technical equipment, or other items added after the estimate was issued will be added to the final rental total and are payable at that time.

If delivery by Starting Arts is requested, the Renter agrees to pay any applicable delivery fee based on the delivery location.

3. Payment

The Renter agrees to provide payment by check or credit card at the time of pickup as applicable. A 3% fee will be applied to Credit Card payments

All amounts due under the rental estimate, including any additional items selected at pickup or delivery, must be paid according to the terms of this agreement.

Any additional charges incurred during or after the rental period, including but not limited to damage, replacement costs, late fees, additional consultation, or other authorized charges, remain the responsibility of the Renter.

4. Care and Use of Rental Items

The Renter agrees to abide by all Starting Arts rental policies and regulations and assumes responsibility for the actions of all employees, volunteers, participants, contractors, and other associates of the Renter.

The Renter and members of the Renter's organization may not change the color, shape, appearance, or function of any rented item unless specifically authorized in writing by Starting Arts.

Unauthorized alterations, modifications, or loss of rental items may result in the Renter being charged the full replacement cost of the affected item or items.

Additionally:

• Costumes must be cleaned before being returned to Starting Arts.

• Props must be sprayed or sanitized before return and carefully packed in appropriate boxes or containers to prevent bending, breaking, or damage to delicate items.

• The Renter is responsible for repairing or arranging repair of minor damage that occurs during the rental period, including, but not limited to, reattaching components, mending seams, replacing screws, or similar repairs.

• Any damage, including minor damage or repairs made by the Renter, must be disclosed to Starting Arts when the complete rental package is returned.

• The Renter agrees to pay the full replacement cost for any costume, prop, set piece, or technical equipment that is lost, destroyed, stolen, or damaged beyond reasonable repair.

5. Damage and Replacement Costs

The Renter is financially responsible for all rental items from the time they are picked up or delivered until they are returned to and accepted by Starting Arts.

If an item is lost, stolen, destroyed, or damaged beyond reasonable repair, the Renter agrees to pay the full replacement cost, as determined by Starting Arts.

Starting Arts may also charge for repairs, replacement materials, labor, cleaning, restoration, or other costs necessary to return damaged items to their original rental condition.

6. Late Returns

The Renter agrees to return all rental items by the agreed-upon return date.

Late fees will be assessed at $50 per day, beginning on the day after the agreed-upon return date and continuing until all rental items have been returned to Starting Arts.

7. Assumption of Risk and Indemnification

The Renter agrees that all employees, volunteers, participants, contractors, and other associates of the Renter shall use all rented items at their own risk.

Neither Starting Arts nor its employees, representatives, volunteers, or associates shall assume responsibility for any damage, injury, or death resulting from the use, misuse, handling, installation, or operation of any item included in this rental agreement.

The Renter agrees to indemnify and hold harmless Starting Arts and its employees, representatives, volunteers, and associates from any and all claims, damages, liabilities, losses, costs, or expenses arising from or relating to the use or misuse of any item covered by this agreement.

8. Amendments

Any amendment, modification, or change to this agreement must be made in writing and signed by both parties.

9. Cancellation

Starting Arts reserves the right to cancel a rental agreement at any time.

10. Limitation of Liability

UNDER NO CIRCUMSTANCES, AND UNDER NO LEGAL THEORY, WHETHER IN TORT, CONTRACT, OR OTHERWISE, SHALL STARTING ARTS BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF GOODWILL, LOSS OF PROFITS, LOSS OF USE, OR COST OF COVER, ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE RENTAL, USE, OR CONDITION OF ANY ITEM PROVIDED BY STARTING ARTS.

11. Agreement and Acceptance

By signing below, the Renter acknowledges that they have read, understood, and agreed to all terms and conditions of this Rental Agreement.

The Renter further acknowledges that:

1. A rental estimate will be provided before pickup or delivery.

2. The Renter agrees to pay the amount stated in the rental estimate at pickup or delivery, as applicable.

3. The Renter is responsible for payment for any additional costumes, props, set pieces, technical equipment, or other rental items added after the estimate was issued.

4. Costume rentals are subject to a minimum rental charge of $100.

5. The Renter accepts financial responsibility for all rented items until they are returned to and accepted by Starting Arts.
